In recent years, there has been a significant number of dispute cases arising from medical aesthetics. I have handled many such cases, representing patients who sue medical aesthetic institutions. One of the most common issues is that these institutions lack the necessary qualifications and operate without a license. A typical example is beauty salons, which are only permitted to provide skin care services but end up performing injections or even surgeries—this is clearly illegal. Additionally, even in legally operating medical hospitals, the qualifications of the doctors performing the surgeries are often problematic. Medical licenses are categorized, and if a doctor without a plastic surgery qualification performed a plastic surgery, it is also illegal. Moreover, according to China law, the doctor must be officially registered to practice at that specific hospital. If the hospital brings in a doctor from outside to perform a surgery, that is also illegal. Another advantage for patients in plastic surgery disputes is that if the institution engages in misleading advertising, the Consumer Rights Protection Law can be applied, allowing for a refund plus triple compensation.
