How should a company name its trademark in China

When registering a trademark for the first time, how should a company name it? Generally, when a company registers a trademark for the first time, it will use its own company name to register the trademark. For example, Caterpillar Inc. registered the “Caterpillar” trademark, and Toyota registered the “Toyota” trademark. However, there are special cases where it is not convenient for a company to use its own name for the trademark. In such cases, the trademark needs to be created manually.

This process of manually naming a trademark can be divided into three types. The first is a creative name, such as the trademark “Sony.” Sony is an invented word with no specific meaning, and it does not directly evoke associations with any electronic products. Such creative trademarks are the easiest to be recognized and approved by the trademark office.

The second type is an associative trademark, such as the trademark “Wahaha.” It is a beverage that makes people think of a child laughing happily after drinking it. Such associative trademarks can also be recognized and approved by the trademark office, but the difficulty is higher than that of creative trademarks.

The third type is a generic name, such as the trademark “Little Sheep.” “Little Sheep” is a meaningful term, and when used in a specific industry like hot pot, it becomes challenging for the trademark office to approve it as a trademark. In such cases, the company needs to conduct sufficient promotion to achieve widespread recognition among consumers before it can be registered as a trademark.
