Under Chinese law, the general rule is that you must file your lawsuit in the court at the defendant\u2019s domicile. However, there are several important exceptions:<\/span><\/div>\n<ol class=\"qk-md-ol\" start=\"1\">\n<li class=\"qk-md-li complete\">\n<div class=\"qk-md-paragraph\"><strong class=\"qk-md-strong complete\"><span class=\"qk-md-text complete\">Common Exception #1<\/span><\/strong><span class=\"qk-md-text complete\">: If the defendant has left the couple\u2019s shared residence for more than one year, the plaintiff may file the lawsuit in the court of their own domicile.<\/span><\/div>\n<\/li>\n<li class=\"qk-md-li complete\">\n<div class=\"qk-md-paragraph\"><strong class=\"qk-md-strong complete\"><span class=\"qk-md-text complete\">Exception #2 \u2013 Military Marriages<\/span><\/strong><span class=\"qk-md-text complete\">: If the marriage involves a military member, the case is generally filed with a military court.<\/span><\/div>\n<\/li>\n<li class=\"qk-md-li complete\">\n<div class=\"qk-md-paragraph\"><strong class=\"qk-md-strong complete\"><span class=\"qk-md-text complete\">Exception #3 \u2013 Incarcerated Defendant<\/span><\/strong><span class=\"qk-md-text complete\">: If the defendant is currently serving a prison sentence exceeding one year, the lawsuit must be filed with the people\u2019s court located where the prison is situated.<\/span><\/div>\n<\/li>\n<li class=\"qk-md-li complete\">\n<div class=\"qk-md-paragraph\"><strong class=\"qk-md-strong complete\"><span class=\"qk-md-text complete\">Exception #4 \u2013 International Elements<\/span><\/strong><span class=\"qk-md-text complete\">: If the marriage involves foreign elements (e.g., one party is a foreign national), as long as at least one party holds Chinese nationality\u2014or if the marriage is recognized under Chinese law\u2014the Chinese courts have jurisdiction.<\/span><\/div>\n<\/li>\n<\/ol>\n<div class=\"qk-md-paragraph\"><span class=\"qk-md-text complete\">This is Xuzhou Attorney Lyu Qiang.
