Today we’ll discuss jurisdiction in labor arbitration. I frequently receive inquiries about this topic, with many plantiffs unsure where to file their labor arbitration claims. Common scenarios include: someone says, “I was assigned by my company to work as a salesman in Quanzhou, but the company is based in Nanjing.” Others might say, “I work in construction, and my company is in Beijing but assigned me to a project site in Quanzhou.” In such cases, you need to determine with whom you signed the employment contract. If the company in Beijing signed your labor contract and the seal on the contract belongs to a Beijing Company or Nanjing Company, then you should file your claim in Beijing or Nanjing.
