Across Borders (Part 1): Introduction

BCR_NO_CITY_REPLACE

Trust Across Borders

Introduction: Why I Wrote This Book

Published as part of the Trust Across Borders series.

Why I Wrote This Book

International business is built on trust.

Before companies sign contracts, before money is transferred, and before products are shipped across thousands of kilometers, there is always one fundamental question:

Can I trust the person on the other side?

When that trust exists, international cooperation creates enormous value.

When that trust breaks down, even a simple business transaction can become a difficult dispute.

Over the years, as a PRC lawyer helping foreign businesses resolve commercial disputes involving China, I have gradually realized something important.

Many international disputes are not caused only by bad intentions.

Sometimes they are caused by misunderstanding.

Different languages create barriers.

Different legal systems create confusion.

Different business cultures create different expectations.

Sometimes, people simply do not understand how business and law actually work in another country.

Why China Creates Unique Challenges

China has become one of the world’s most important manufacturing and trading countries.

Its supply chain capabilities, manufacturing scale, and competitive prices have created enormous opportunities for businesses around the world.

However, doing business with China also presents unique challenges.

Foreign businesses may face unfamiliar laws, unfamiliar procedures, language barriers, and difficulties finding reliable local professionals.

Many entrepreneurs come to China with extensive business experience from their own countries.

But business experience in one legal system does not always translate directly into another country’s legal and commercial environment.

A contract that seems reasonable under one legal system may create unexpected problems under another.

A business practice that seems normal in one culture may create misunderstanding in another.

The purpose of this book is not to judge one country against another.

China, like every country, has strengths and weaknesses.

My goal is simply to help readers better understand the reality of doing business with China.

Because understanding is the first step toward cooperation.

Why I Started Writing

When I first began writing about Chinese law in English, I was not trying to build a business.

I was not trying to create a personal brand.

I simply believed that foreign businesses needed more practical information about Chinese legal practice.

Many English-language discussions of Chinese law were written from academic perspectives.

They were often valuable.

But foreign businesses were usually asking different questions.

They wanted to know:

What happens when a Chinese supplier fails to perform?

How can a foreign company recover money from China?

Why can a case that appears straightforward still become difficult in court?

What should a company do before problems arise?

These questions require more than knowledge of statutes.

They require experience with real disputes, real courts, and real business situations.

I wanted to share that practical perspective.

What This Book Is — and Is Not

This is not a complete guide to Chinese law.

No single book can eliminate every risk involved in international business.

Legal disputes are complicated.

Business decisions involve uncertainty.

Human behavior is unpredictable.

This book does not promise that readers will never encounter problems.

Instead, I hope it helps readers think differently.

To recognize risks earlier.

To communicate more effectively.

To understand the importance of contracts, evidence, compliance, and professional advice.

Most importantly, I hope it helps readers better understand the people behind international business relationships.

A Different Kind of Legal Book

This book is also not simply my personal story.

My experiences are only the background.

The real subjects are much larger:

Trust.

Responsibility.

Good faith.

Communication across cultures.

A healthy international business environment requires far more than factories, products, and competitive prices.

It requires people who respect agreements.

Companies that value reputation.

Professionals who take responsibility.

And individuals who understand that long-term relationships are often more valuable than short-term gains.

Why This Book Exists

I have always believed that sincere efforts made to help others are rarely wasted.

When I first started writing articles about Chinese legal practice, I did not know whether anyone would ever read them.

I did not know whether they would ever bring me clients.

I only believed one thing:

If my writing could help even one person make a better decision, then it was worth writing.

Over time, those articles connected me with people from many different countries.

They taught me that behind every international dispute there is not only a legal problem.

There is usually a person.

A business owner.

A family.

A dream.

Someone who took a risk and hoped to build something better.

This book was not written to convince you to trust me.

It was written so that you can decide for yourself whether I deserve your trust.

Because true trust cannot be demanded.

It can only be earned.

← Previous Chapter

This is the beginning of the Trust Across Borders series.

→ Chapter 1:
