Issue: Multi-class trademark protection before entering the Chinese market

The client planned to launch several premium product lines in mainland China and required a coordinated trademark strategy covering both English-language marks and carefully selected Chinese-language equivalents. Preliminary clearance searches identified several earlier-filed applications and potentially conflicting trademarks that could affect registration and future enforcement.

Resolution: We conducted comprehensive trademark clearance searches, developed a filing strategy covering multiple Nice Classes, advised on Chinese-language branding, and coordinated trademark applications before the China National Intellectual Property Administration (CNIPA). Potential conflicts were addressed through filing strategy adjustments and legal risk analysis, enabling the client's core trademark portfolio to proceed successfully while significantly strengthening long-term brand protection in China.

Client: German industrial automation manufacturer

Issue: Protection of proprietary manufacturing technology in China

Prior to establishing manufacturing operations in China, the client sought long-term patent protection for a sophisticated automated production system involving multiple technical innovations. The project required careful claim drafting to maximize protection while minimizing examination risks.

Resolution: We coordinated patent filing strategy, worked closely with patent professionals on claim drafting, managed communications with CNIPA throughout substantive examination, and handled multiple Office Action responses. Resolution: We implemented a coordinated online enforcement program involving evidence preservation, trademark verification, platform complaints, repeat-infringer monitoring, and follow-up takedown actions. Resolution: We coordinated investigations, preserved evidence through notarization, worked closely with local administrative enforcement authorities, and supported multiple enforcement actions targeting manufacturing and distribution facilities. Large quantities of counterfeit products were seized, unlawful production activities ceased, and the client significantly strengthened protection of its China distribution network.

Issue: Unauthorized commercial use of registered trademarks

A domestic competitor adopted a trademark highly similar to the client's registered mark and marketed competing products through nationwide distribution channels, creating significant marketplace confusion and damaging the client's commercial reputation in China.

Resolution: Following comprehensive infringement analysis and evidence preservation, litigation was commenced before the competent Chinese People's Court. The court confirmed trademark infringement, ordered the immediate cessation of unauthorized use, awarded monetary damages, and required the infringing party to bear a substantial portion of the litigation costs, significantly reinforcing the client's trademark rights in the Chinese market.

Client: United States cybersecurity software company

Issue: Large-scale unauthorized commercial deployment of proprietary software

The client identified numerous Chinese enterprises using unlicensed copies of its commercial software across multiple provinces. The infringements involved unauthorized installation, reproduction, commercial deployment, and internal business use, requiring a coordinated enforcement strategy.

Resolution: We coordinated forensic evidence collection, software authentication, notarized preservation procedures, and a phased enforcement strategy combining cease-and-desist demands with coordinated copyright litigation against selected infringers. Multiple settlements were achieved, court judgments confirmed copyright infringement, monetary compensation was recovered, and the enforcement campaign substantially reduced unauthorized commercial use throughout the Chinese market.
