Behind me is the Yunlong District People’s Court. Today, I am here for a construction project case. In this case, a shareholder of the defendant issued a letter of commitment to the plaintiff. The content of the letter stated that if the defendant failed to make payments on time, the shareholder would make the payment on its behalf. Ultimately, this letter of commitment was recognized by the court as a guarantee. According to judicial interpretations from China’s Supreme Court, commitment letters containing terms such as credit enhancement or deficiency payments can be recognized by the court as guarantees.
